Does Expense Reduction Analysts have an obligation to develop a Central Billing Service?

- We reserve the right, but do not have the obligation, to develop, designate and/or otherwise approve a Central Billing Service for use in connection with the franchise System. If we designate a Centralized Billing Service (Section 6.1 of the Franchise Agreement)
If the Centralized Billing Service is adopted, all payments made by your clients in connection with your Consulting Business are to be transferred directly to a bank account associated with the Centralized Billing Account, pursuant to such forms that we may require to you complete, as attached to the Franchise Agreement, or as set forth in the Manuals or in any other writing. What This Means (2025 FDD)
According to the 2025 Expense Reduction Analysts Franchise Disclosure Document, Expense Reduction Analysts is not obligated to develop a Central Billing Service. Expense Reduction Analysts has the right, but not the obligation, to develop, designate and/or otherwise approve a Central Billing Service for use in connection with the franchise System.
If Expense Reduction Analysts designates a Centralized Billing Service, all payments made by a franchisee's clients in connection with their Consulting Business are to be transferred directly to a bank account associated with the Centralized Billing Account. This process would be implemented according to forms that Expense Reduction Analysts may require the franchisee to complete, as attached to the Franchise Agreement, or as set forth in the Manuals or in any other writing.
This means that Expense Reduction Analysts retains the discretion to implement a centralized billing system, but franchisees cannot rely on this as a guaranteed service. If implemented, franchisees must adhere to the specified payment procedures, which could impact their cash flow management and administrative processes.
