Under what condition can Competitive Beverages be served at individual events or functions at an Even Hotels location?

Notwithstanding anything in this Agreement to the contrary, Competitive Beverages may be served at individual events or functions at any Hotel if the party booking the event or function requires as a condition of booking the event that Competitive Beverages be served.
In such case, Competitive Beverages may be made available only in connection with and during such event or function; provided, however, that: (i) such Competitive Beverages are sold or made available only within the area being used for the event or function, (ii) any advertisements for such Competitive Beverages at the relevant Hotel will be reasonable under the circumstances and generally de minimis in nature (preferably, only within the booked space) and will not suggest that such Competitive Beverages are associated in any manner with Customer or the Hotel.
Either Customer or the party booking the event or function will be responsible for all expenses in any way related to the service of Competitive Beverages, including the provision of equipment, if necessary.
Each Hotel shall use commercially reasonable efforts to minimize the incidence of Competitive Beverage services.

According to Even Hotels' 2025 Franchise Disclosure Document, Competitive Beverages can be served at individual events or functions at any Even Hotels location if the party booking the event requires it as a condition of booking.
In such cases, the Competitive Beverages can only be available in connection with and during the event or function. The beverages must be sold or made available only within the area being used for the event. Any advertisements for the Competitive Beverages at the hotel should be reasonable and minimal, preferably only within the booked space. The advertisements should not suggest that the Competitive Beverages are associated with the Customer (the franchisee) or the hotel.
Either the Customer (the franchisee) or the party booking the event or function will be responsible for all expenses related to the service of Competitive Beverages, including providing equipment if necessary. Each Even Hotels location should make commercially reasonable efforts to minimize the incidence of Competitive Beverage services.
