Notwithstanding the occurrence of any events constituting force majeure, or any other cause, construction shall be completed and the Hotel shall be furnished, equipped and shall otherwise be made ready to open for business in accordance with the License not later than the Opening Deadline set forth in Attachment "A" (or such other date as IHG and Licensee may agree in writing).

What This Means (2025 FDD)

According to Even Hotels' 2025 Franchise Disclosure Document, construction must be completed, and the hotel furnished, equipped, and ready to open for business by the Opening Deadline outlined in Attachment "A". This deadline can be extended if both Even Hotels and the franchisee agree to a different date in writing.

Even if events constituting force majeure occur, the construction and preparation for opening must still meet this deadline, unless an alternative agreement is reached with Even Hotels. Even Hotels has the discretion to determine whether construction aligns with these plans.
