What This Means (2025 FDD)
According to Even Hotels' 2025 Franchise Disclosure Document, AT&T can disclose specific information about an Even Hotels franchisee (referred to as "Eligible Participant") to the Customer upon request. This information includes the franchisee's name, the services purchased from AT&T, monthly or annual usage of those services, total billings, and payment status. However, AT&T cannot disclose the Customer's information to the franchisee without the Customer's consent. This reciprocal arrangement ensures that both parties have control over the release of their data.
This disclosure policy is part of a Participation Agreement between the franchisee, AT&T, and the Customer. The agreement explicitly states that the franchisee is solely liable for its obligations and liabilities under the agreement, reinforcing the independent nature of the arrangement. AT&T is not responsible for the franchisee's performance, and the agreement is considered independent between the franchisee and AT&T.
This arrangement has implications for the Even Hotels franchisee. It allows the Customer to monitor the franchisee's usage and payment behavior related to AT&T services, which could be important for maintaining service quality or managing costs. The franchisee should be aware that this information is subject to disclosure and ensure they manage their account responsibly. The franchisee also benefits from the assurance that their customer's data will not be shared without consent, maintaining privacy and trust.
In the event of disputes, the agreement also includes a clause regarding legal actions. If the franchisee, a group of franchisees, or the Customer brings similar claims against AT&T, AT&T can apply to consolidate these actions into a single proceeding. The franchisee agrees not to contest such a motion, streamlining the legal process and potentially reducing costs. This clause highlights the importance of understanding the full scope of the Participation Agreement and its potential impact on legal proceedings.
