At Even Hotels, are Hotels obligated to purchase Tea from the Company, or do they simply have the right to purchase it?

Each Hotel may, but is not obligated to, serve in the Hotels Gold Peak**®** Fresh-Brewed Tea (and/or any other Tea brand that Company may make available). If Customer elects to serve Company's Tea, Customer agrees that in no event will Customer serve any Teas that are a Product of PepsiCo in its Hotels.
Each Hotel will have the right to purchase Tea from Company at Company's then-current published chain account prices, which prices are subject to change from time to time.
Customer is responsible for purchasing all Tea Dispensers and blending equipment for all applicable Hotels.
Any service on the Tea Dispensers or blending equipment will be at the cost and responsibility of Customer.

What This Means (2025 FDD)
According to Even Hotels' 2025 Franchise Disclosure Document, hotels have the option, but are not required, to serve Gold Peak Fresh-Brewed Tea or any other tea brand that the company may offer. However, if an Even Hotel chooses to serve the company's tea, they are prohibited from serving any teas that are products of PepsiCo.
Each Even Hotel has the right to purchase tea from the company at the company's current published chain account prices, which are subject to change. The franchisee is responsible for purchasing all tea dispensers and blending equipment for their hotels.
Any service needed on the tea dispensers or blending equipment will be at the cost and responsibility of the franchisee. This arrangement allows Even Hotels franchisees flexibility in their beverage offerings while ensuring brand consistency if they choose to participate in the tea program.
