What This Means (2025 FDD)

According to Even Hotels' 2025 Franchise Disclosure Document, any notices to Bank of America, N.A., the Bank, must be sent to a specific address in Louisville, Kentucky. The address is Bank of America, N.A., 9200 Shelbyville Road, Suite 200, KY6-225-0202, Louisville, KY 40222, and the notices should be directed to the Attention: Operations Manager.

This instruction is important for Even Hotels franchisees because it ensures that any official communication intended for the bank reaches the correct department and is processed efficiently. This could include notifications related to financial transactions, account updates, or any other contractual matters involving the bank. Sending notices to the wrong address could result in delays or a failure to properly address important issues.

The FDD also specifies how notices are considered to be given depending on the delivery method. If sent by mail, notice is deemed given five days after mailing or when actually received, whichever is earlier. If sent by courier, notice is given when delivered. If sent by facsimile, notice is effective when the courier confirmation copy is received. Any other method of notice is effective only when actually received. This level of detail helps to avoid ambiguity and potential disputes regarding whether a notice was properly given.

It is also noted that notices sent to the franchisee's last known address, as indicated in the franchisor's records, will be considered effective. Therefore, it is crucial for Even Hotels franchisees to keep their contact information updated with the franchisor to ensure they receive all important communications.
