What This Means (2025 FDD)
According to Even Hotels' 2025 Franchise Disclosure Document, franchisees have the option to dispute chargebacks. The FDD states that franchisees may dispute a chargeback as provided in the Card Organization Rules, including any requirements for timely submission. The franchisor's obligation regarding chargeback disputes is limited to presenting the franchisee's dispute to the appropriate Card Organization, to the limited extent required by Card Organization Rules. Even Hotels will not engage in direct collection efforts against cardholders on the franchisee's behalf. The Your Payments Acceptance Guide contains additional details and requirements related to Chargebacks.
It is important to note that the franchisee is responsible for reimbursing Even Hotels for all transactions that are charged back, including the chargebacks themselves, any related fees, fines, penalties, assessments, and other amounts related to disputing or arbitrating a chargeback. This includes fees regardless of whether the chargeback is settled in the franchisee's favor or the cardholder's favor.
Additionally, the FDD outlines specific scenarios where FreedomPay, a third-party payment processor, is not liable for chargebacks. For example, if the hotel disables the CVV prompt for manual transactions or if a PIN key is not available for chip and PIN cards, the hotel may be liable for fraud or chargebacks. The franchisee acknowledges that disabling preferred Card Verification Method (CVM) requirements for chip cards is at the hotel's sole risk, and FreedomPay will not be liable for fraud claims or chargebacks resulting from such disablement.
