What This Means (2025 FDD)

According to Even Hotels' 2025 Franchise Disclosure Document, 'Applicable Law' in the context of the agreement means that both parties, the franchisee and franchisor, must comply with all relevant federal, state, and local employment and other laws, government regulations, and orders. This obligation ensures that the Even Hotels business operates within the legal boundaries set by various governmental bodies.

This requirement has significant implications for a prospective Even Hotels franchisee. It means the franchisee is responsible for understanding and adhering to a wide array of laws and regulations that can impact various aspects of the business, including employment practices, workplace safety, and general business operations. Non-compliance can lead to legal penalties, fines, and potential damage to the brand's reputation.

Furthermore, the agreement specifies that it will be construed in accordance with the laws of the State of Georgia, and any legal claims or actions related to the enforcement of the agreement must be pursued in the state or federal courts located in Fulton or DeKalb County, Georgia. This clause dictates the legal framework and venue for resolving disputes, which could be a crucial consideration for franchisees located outside of Georgia. Franchisees should seek legal counsel to fully understand their obligations and rights under these provisions.
