What This Means (2025 FDD)

According to the 2025 Epcon Communities Franchise Disclosure Document, upon termination or expiration of the Franchise Agreement, the franchisee must immediately stop using the Marks, the Epcon Communities Works, and the Development System. The franchisee is also required to promptly return all materials provided by Epcon Communities. This obligation is clearly outlined in Item 23 of the FDD, emphasizing the importance of ceasing all association with the brand and its proprietary systems upon the end of the agreement.

Epcon Communities retains the right to enter the premises of any project undertaken by the franchisee to remove or obliterate any Marks at the franchisee's expense, without prior notice. The franchisee is responsible for indemnifying and protecting Epcon Communities from any claims related to property damage during the removal or obliteration of such Marks. This provision ensures that the brand's identity is protected and that the franchisee does not continue to represent themselves as part of the Epcon Communities network after the agreement concludes.

Additionally, the franchisee's access to the Epcon Communities Intranet will be terminated immediately without notice if they fail to maintain authorized franchisee status. Upon termination of the agreement or the right of access, the franchisee must immediately stop accessing the Epcon Communities Intranet, including the website and databases. This includes deleting all information pertaining to the franchisee and revoking authorization to use the Intranet. This is a standard practice in franchising to ensure that only current franchisees have access to confidential and proprietary information.

These measures are in place to protect Epcon Communities' brand integrity, proprietary information, and development system. Prospective franchisees should understand these obligations and be prepared to comply with them upon termination or expiration of their franchise agreement. Failure to comply could result in legal action and financial penalties.
