Under certain circumstances, we may grant you an extension of time to use the rights to the Development System granted to you under your Market Area Agreement, and under certain circumstances, even though your rights to use the Development System have terminated, you may complete construction of Units in your project (during a period of time not to exceed one year).

What This Means (2025 FDD)
According to Epcon Communities' 2025 Franchise Disclosure Document, under certain circumstances, a franchisee may be granted the ability to complete construction of Units in their project even after their rights to use the Development System have terminated. This extension is limited to a period not exceeding one year.
This provision allows franchisees to finish projects already underway, providing a safety net to avoid significant losses if the franchise agreement ends prematurely. This is particularly important in real estate development, where projects can span several years and involve substantial investment. The FDD does not elaborate on what specific circumstances would warrant such an extension, so it's important for prospective franchisees to understand the conditions under which Epcon Communities would grant this privilege.
It is important for potential franchisees to discuss with Epcon Communities the specific conditions under which such an extension might be granted. Understanding these conditions is crucial for managing risk and ensuring the successful completion of development projects. Franchisees should seek clarity on what constitutes acceptable progress, what events might trigger termination, and what recourse they have to protect their investment in ongoing projects.
