What This Means (2025 FDD)
According to Epcon Communities' 2025 Franchise Disclosure Document, Epcon Communities is not obligated to enforce the Intranet agreement against any user. While Epcon Communities reserves the right to investigate and take action against illegal or improper uses of the Intranet, including deleting information and revoking access, they are not required to do so.
This means that Epcon Communities has the discretion to decide when and how to enforce the Intranet agreement. A franchisee cannot depend on Epcon Communities to actively police the Intranet or to take action against other users who may be violating the agreement.
This lack of obligation could present risks for franchisees. For example, if another user posts inappropriate or harmful content, Epcon Communities is not required to remove it. Franchisees must understand that the Intranet is provided "AS IS" and "AS AVAILABLE," and Epcon Communities does not guarantee its safety or proper use by all users. Franchisees need to be aware of the terms and conditions and what recourse they have if they encounter issues with other users. They should also consider what steps they can take independently to protect their interests, as Epcon Communities is not obligated to act.
