What This Means (2025 FDD)

According to the 2025 Epcon Communities Franchise Disclosure Document, a franchisee must fully implement the Development System only within the Initial Market Area depicted on Exhibit "A" of the Initial Market Area Agreement. The franchisee cannot use the Development System anywhere except at the agreed location within this Initial Market Area. Unauthorized use of the Development System would violate the Initial Market Area Agreement and the Franchise Agreement, giving Epcon Communities the rights and remedies outlined in the Franchise Agreement.

Epcon Communities grants the franchisee a license to use the Development System under the terms and conditions of the Franchise Agreement. The franchisee's success depends on strict adherence to Epcon Communities' standards, procedures, and plans. The franchisee must preserve the integrity of Epcon Communities' materials, reputation, and goodwill.

Before developing an Epcon Communities Project, the franchisee conducts an independent analysis to determine if the project will be successful. Epcon Communities' review and opinion about any project location is only an opinion based on limited information and criteria for Epcon Communities Projects. It does not guarantee the project's success, and the franchisee cannot make any claims against Epcon Communities if the project does not meet expectations.
