What This Means (2025 FDD)
According to the 2025 Epcon Communities Franchise Disclosure Document, if Epcon Communities holds an annual meeting or conference of franchisees, the franchisee, or a representative of the franchisee's management, must attend all sessions unless excused by Epcon Communities in writing. The representative must be satisfactory to Epcon Communities in its sole discretion. The franchisee is responsible for all costs and expenses associated with attending the meeting or conference.
This means that Epcon Communities retains control over who represents a franchisee at these important events. The requirement for a "representative of Franchisee's management satisfactory to Franchisor" gives Epcon Communities the ability to reject a proposed representative if they do not believe that person is suitable. This could be based on the individual's experience, knowledge, or even their personal demeanor.
For a prospective franchisee, this highlights the importance of maintaining a good relationship with Epcon Communities. If the franchisee cannot attend the annual meeting themselves, they need to ensure that they have someone in their management team who will be approved by Epcon Communities. Failure to comply with this requirement could potentially lead to a breach of the franchise agreement. It is also important to factor in the cost of attending these meetings, as the franchisee is responsible for all travel, lodging, and meal expenses.
