Under the Franchise Agreement, we will grant you the right and license to operate your Franchised Business within a Territory. The Territories will vary in size and dimension based on local factors, but a "standard" Territory will generally be determined as a geographic area containing approximately 100 schools with grades including some or all of kindergarten through eighth grade.

What This Means (2025 FDD)
According to the 2025 Engineering For Kids FDD, a standard territory is generally determined by the geographic area containing approximately 100 schools with grades including some or all of kindergarten through eighth grade. However, the FDD also states that territories will vary in size and dimension based on local factors.
While Engineering For Kids grants franchisees a territory, it is not exclusive. Franchisees may face competition from outlets that Engineering For Kids owns, other channels of distribution, or competitive brands that Engineering For Kids controls. Engineering For Kids retains the right to conduct business activities under any name, in any geographic area, and at any location, regardless of its proximity to the franchisee's Engineering For Kids business.
Engineering For Kids also maintains the right to establish Engineering For Kids businesses at any location outside the territory, establish businesses and programs under other systems or proprietary marks (even if they offer similar services), establish Engineering For Kids businesses at any Large Accounts inside or outside the territory, acquire and operate any business or program of any kind (as long as it is not an Engineering For Kids business inside the territory), provide and conduct Special Event Services within the territory if the franchisee does not, and sell products and services through alternative distribution channels like e-commerce. However, Engineering For Kids will not sell or license directly to schools located in the franchisee's territory the curriculum that is licensed to Engineering For Kids Businesses as part of the Proprietary Materials for franchisees' use in conducting the Programs, for the purpose of allowing such schools to use that curriculum to conduct the Programs directly with their students in the schools.
