- 10.3.2. To use the Proprietary Marks only for the operation of the Franchised Business in the Territory and in advertising the Franchised Business inside the Territory;

What This Means (2025 FDD)
According to the 2025 Engineering For Kids FDD, a franchisee can use the Proprietary Marks only for the operation and advertising of their Franchised Business inside their designated Territory. The franchisee must operate and advertise the Franchised Business under the name "Engineering For Kids" without any additional prefixes or suffixes. Additionally, the Proprietary Marks must be used with the appropriate symbol, such as "®", "™", or "SM", as required by Engineering For Kids.
Engineering For Kids grants the franchisee the right and obligation to use the Proprietary Marks and the System to operate one Franchised Business within the designated Territory for the duration of the agreement. This includes offering programs and selling authorized products at authorized locations, such as Third Party Sites and EFK Center Locations, to customers attending these programs. It also includes offering Special Events Services at customers' homes or other facilities and providing additional services and programs like Virtual Programs, as approved by Engineering For Kids.
However, the franchisee's license to use the Proprietary Marks and System does not extend to wholesale transactions, e-commerce, or sales through other distribution channels, except for authorized Virtual Programs. The franchisee also cannot license or sublicense the Proprietary Marks or the System to anyone else. These restrictions ensure that Engineering For Kids maintains control over its brand and service quality, while also defining the scope of the franchisee's operational rights within their Territory.
It is important to note that upon termination or expiration of the Franchise Agreement, the franchisee must cease all use of the Proprietary Marks. This includes discontinuing the use of the Engineering For Kids name and any associated logos or trademarks in their business operations and advertising. This provision protects Engineering For Kids's intellectual property and ensures a consistent brand identity across all franchise locations.
