What This Means (2025 FDD)

According to Engineering For Kids' 2025 Franchise Disclosure Document, the personal guaranty form, titled "PERSONAL GUARANTY", is included as Appendix B to the FDD. This form is required to be signed by the owners of a corporation, partnership, limited liability company, or other entity to whom Engineering For Kids grants a franchise.

The personal guaranty ensures that the owners of the franchisee entity unconditionally guarantee to Engineering For Kids that all obligations of the company under the Franchise Agreement will be fulfilled. This includes the punctual payment and performance of all agreements and arrangements between the company and Engineering For Kids. The liability of the guarantors is joint and several, meaning each guarantor is fully responsible for the entire obligation.

The guaranty also includes a waiver by the guarantors of any right to require Engineering For Kids to proceed against the company or any other guarantor, pursue any security from the company or any other guarantor, or exhaust any remedy against the company or any other guarantor. Engineering For Kids may extend, modify, or release any obligation without notice to the guarantors, and the guarantors waive notice of any amendments to the Franchise Agreement. This ensures that Engineering For Kids has direct recourse to the personal assets of the owners should the franchisee entity fail to meet its obligations.
