Can Engineering For Kids change the policies related to data use?

- 8.5.7. We have the right to specify, from time to time, in the Manual or otherwise in writing, the Data and other information that you must collect and maintain on the Computer System in the manner that we prescribe.
We may use all such information, data, and reports in any manner, including, without limitation, providing financial and operating reports to franchisees and operators operating under the System.
With respect to any Data from your Franchise Business that we maintain, we grant a royalty-free non-exclusive license to you to use the Data while this Agreement (including any successor agreement) is in effect, but only in connection with operating the Franchised Business and only in accordance with the policies that we periodically establish (which may include, without limitation, terms and conditions relating to use, retention, storage and/or removal).
(b) You agree not to publish, disseminate, implement, revise, or rescind a data privacy policy without our prior written consent as to said policy.
8.5.4. You agree to implement and periodically upgrade and make other changes to the Computer System and Required Software as we may reasonably request in writing (collectively, "Computer Upgrades").

What This Means (2025 FDD)
According to Engineering For Kids' 2025 Franchise Disclosure Document, Engineering For Kids has the right to modify policies related to data use. Engineering For Kids can specify the data and other information that franchisees must collect and maintain on their computer systems, as detailed in the manual or in writing.
Engineering For Kids also has the right to use the data collected by franchisees in any manner they deem appropriate without compensating the franchisee. While franchisees are granted a royalty-free, non-exclusive license to use the data, this use is restricted to operating the franchised business and must comply with the policies Engineering For Kids establishes, which may include terms and conditions related to use, retention, storage, and removal.
Furthermore, franchisees must agree not to publish, disseminate, implement, revise, or rescind a data privacy policy without Engineering For Kids' prior written consent. This indicates that Engineering For Kids maintains control over data privacy policies and can change them as needed. Franchisees must also implement and periodically upgrade their computer systems and required software as reasonably requested by Engineering For Kids in writing.
