Franchisee acknowledges that the provisions of this Section 16 have been inserted for the sole benefit of Franchisor and that Franchisor shall have the right, from time to time during the Term, in its sole discretion, to waive in whole or in part or otherwise reduce the scope of any covenant set forth in this Section 16 or any portion of this Agreement without Franchisee's consent effective upon Franchisor giving notice to Franchisee.

Franchisee expressly agrees to be bound by any lesser covenants subsumed within the terms of this Section 16 as if the resulting covenants were separately stated in and made a part of this Agreement.
