Subject to the terms of this Agreement, Franchisor hereby grants to Franchisee the non-exclusive right to establish and operate an ENGEL & VÖLKERS® residential real estate brokerage at the Approved Location for the provision of real estate brokerage services with respect to residential properties of the type permitted under Section 2.2 using the ENGEL & VÖLKERS System and Trademarks (the "Residential Real Estate Brokerage").

According to Engel & Volkers' 2025 Franchise Disclosure Document, franchisees are granted the right to operate a residential real estate brokerage using the Engel & Volkers system and trademarks. Engel & Volkers grants franchisees the right to use the trademark ENGEL & VÖLKERS® for residential real estate brokerage services.
Engel & Volkers' franchisees can only offer real estate brokerage services for residential properties, which include houses, buildings, apartments, undeveloped land, leaseholds, vacation and resort residential units, cooperatives, and condominiums. Franchisees may offer commercial real estate brokerage services as long as it is ancillary to residential properties, they do not present themselves as a commercial real estate brokerage, and their commercial property listings do not exceed 5% of all listings in a calendar year.
The Engel & Volkers franchise agreement specifies that franchisees must operate their residential real estate brokerage under the ENGEL & VÖLKERS trade name. Franchisees must also ensure their brokerage location and exterior designs comply with the Engel & Volkers system and system documentation. This means that franchisees must adhere to Engel & Volkers' brand standards in all aspects of their business operations.
