Franchisee acknowledges that Franchisor has developed, and may from time to time develop, programs and designations that are only available to franchisees who meet certain criteria and that Franchisor may make adaptations and modifications to the ENGEL & VÖLKERS System related to such programs and designations. Franchisee further acknowledges and agrees that entering into this Agreement does not require Franchisor to make adaptations and modifications to the ENGEL & VÖLKERS System related to such programs and designations available to Franchisee, or entitle Franchisee to participate in such programs or obtain such designations. What This Means (2025 FDD)
According to Engel & Volkers' 2025 Franchise Disclosure Document, Engel & Volkers is not required to make adaptations and modifications to its system related to programs and designations available to all franchisees. Engel & Volkers may develop programs and designations only available to franchisees meeting certain criteria and may modify the Engel & Volkers system related to these programs.
However, the agreement does not require Engel & Volkers to make these adaptations and modifications available to all franchisees, nor does it entitle all franchisees to participate in such programs or obtain such designations. Franchisees do not have the right to demand disclosure of any such program, designation, or variation, or to be granted the same or a similar variation.
This means that as an Engel & Volkers franchisee, your access to certain programs and designations within the Engel & Volkers system may be limited based on criteria set by the franchisor. You cannot compel Engel & Volkers to provide you with access to these exclusive programs or to modify the system to accommodate your participation if you do not meet the specified criteria.
