What This Means (2025 FDD)
According to Engel & Volkers' 2025 Franchise Disclosure Document, operating an Administrative Location does not guarantee an extension of its term. The decision to grant another limited purpose location or extend the term of the current Administrative Location remains at Engel & Volkers' sole discretion. This means that even if a franchisee successfully operates an Administrative Location, Engel & Volkers is not obligated to allow them to continue operating it beyond the initial term.
This policy carries significant implications for prospective franchisees. It introduces uncertainty regarding the long-term viability of the Administrative Location. A franchisee might invest time and resources into establishing and running the location, only to find that Engel & Volkers decides not to extend the term. This could disrupt the franchisee's business operations and potentially lead to financial losses.
In the franchise industry, it is common for franchise agreements to include renewal options, often based on the franchisee's performance and compliance with the franchise agreement. However, in the case of Engel & Volkers' Administrative Locations, the extension is not guaranteed, making it crucial for franchisees to carefully consider this aspect before investing in such a location. Franchisees should seek clarification from Engel & Volkers regarding the criteria and factors that will be considered when deciding whether to extend the term of an Administrative Location.
Furthermore, the Engel & Volkers FDD states that the franchisee has no right of first refusal, option, or similar rights to acquire additional franchises or operate any additional administrative locations. This further emphasizes the franchisor's control over the expansion and continuation of administrative locations, adding another layer of risk for franchisees who might be hoping to grow their business through additional locations.
