What advertising materials and displays must an Engel & Volkers franchisee use?

Engel_Volkers Franchise · 2025 FDD

Answer from 2025 FDD Document

You will be responsible for your own local advertising. You must comply with the instructions contained in the System Documentation. You may only use advertising materials and displays prescribed and approved by us. You must obtain our prior written consent for any advertising or sales promotion campaign, unless the advertising or campaign design format does not essentially depart from those previously practiced or recommended by us or outlined in the System Documentation. We may set requirements and restrictions on advertising, promotion and other activities that we determine, in our sole discretion, negatively impacts the business of one or more other franchisees or that is specifically targeted or directed towards the protected areas of one or more other franchisees. Such requirements and restrictions are intended to balance the ability of franchisees to freely compete in the marketplace and the right of a franchisee to operate within its protected area without undue interference from other franchisees.

What This Means (2025 FDD)

According to Engel & Volkers' 2025 Franchise Disclosure Document, franchisees are required to use advertising materials and displays that are prescribed and approved by the franchisor. This means that franchisees cannot independently create their own advertising materials without prior authorization from Engel & Volkers. Franchisees must also adhere to the instructions outlined in the System Documentation, which contains the methods, specifications, procedures, and products for operating the franchised business. Engel & Volkers retains the right to modify the System Documentation.

Engel & Volkers also provides advertising tools and templates, but the specific tools and templates a franchisee uses will depend on the legal requirements in their region. Franchisees are responsible for their own local advertising but must secure written consent from Engel & Volkers for any advertising or sales promotion campaign that significantly deviates from previously approved formats or those recommended by Engel & Volkers and detailed in the System Documentation.

Engel & Volkers may also set requirements and restrictions on advertising, promotion, and other activities to prevent negative impacts on other franchisees' businesses or interference with their protected areas. While franchisees can promote their businesses via alternate online strategies, they are not permitted to have an individual franchisee website. Engel & Volkers has the right to review all online content on social media sites, blogs, electronic communications, and other online sites where their trademarks are used. They may require franchisees to remove questionable content or cease using the trademarks on such sites altogether.
