What This Means (2024 FDD)
According to Endless Summer Sweets's 2024 Franchise Disclosure Document, a franchisee can terminate the franchise agreement if the franchisor violates a material provision of the franchise agreement. However, the franchisee must provide written notice to Endless Summer Sweets of the violation. Endless Summer Sweets then has 30 days to cure the violation or make substantial progress toward curing it. If Endless Summer Sweets fails to do so within the 30-day period, the franchisee can then terminate the agreement.
Additionally, if a franchisee signs a Multi-Unit Development Agreement (MUDA) with Endless Summer Sweets, the franchisee has the right to terminate the MUDA at any time. However, it is important to note that if the franchisee terminates the MUDA, it does not give Endless Summer Sweets the right to terminate the franchise agreement. Conversely, if Endless Summer Sweets terminates the franchise agreement, they do have the right to terminate the MUDA.
It is important for a prospective Endless Summer Sweets franchisee to understand the conditions under which they can terminate the franchise agreement, as well as the implications of terminating a MUDA. Franchisees should carefully review the franchise agreement and MUDA, and seek legal counsel if necessary, to fully understand their rights and obligations.
