[This is our current standard form of General Release. This document is not signed when you purchase a franchise. In circumstances such as a renewal of your franchise or as a condition of our approval of a sale of your franchise, we may require you to sign a general release.]

What This Means (2024 FDD)
According to Endless Summer Sweets' 2024 Franchise Disclosure Document, a franchisee may be required to sign a general release under specific circumstances. This release is not a standard document signed when initially purchasing the franchise. Instead, Endless Summer Sweets might require a franchisee to sign it during a renewal of their franchise agreement or as a condition for the franchisor's approval of a sale of the franchise.
The general release is a legal document where the franchisee (Releasor) releases Endless Summer Sweets Franchising, Inc. (Franchisor) from any and all claims, causes of action, suits, debts, agreements, promises, demands, liabilities, contractual rights, and/or obligations, known or unknown, arising out of events that occurred through the date of the release, including anything arising out of the Franchise Agreement. The franchisee also agrees not to initiate any legal proceedings against Endless Summer Sweets.
This requirement protects Endless Summer Sweets from potential future legal claims by the franchisee, ensuring a clean break or fresh start in the franchise relationship. For a prospective franchisee, this means understanding that signing a general release could be a condition for renewing the franchise or selling it to someone else. It is advisable to seek legal counsel before signing such a release to fully understand the implications and ensure that all rights are protected, especially considering the release covers both known and unknown claims.
