You do not have the right to relocate your business, and we have no obligation to approve any request for relocation. Our policy is to approve relocation of a franchisee's business on caseby-case basis, considering factors such as changes in demographics, profitability of your current business, or a loss of your premises due to circumstances beyond your control.

What This Means (2024 FDD)
According to the 2024 Endless Summer Sweets FDD, franchisees do not have a guaranteed right to relocate their business. Endless Summer Sweets maintains the discretion to approve or deny relocation requests. However, Endless Summer Sweets's policy is to consider relocation requests on a case-by-case basis.
Endless Summer Sweets will consider factors such as changes in the demographics of the area surrounding the current location. If the population has decreased or the key customer base has shifted, Endless Summer Sweets might approve a move to a more viable location. The franchisor will also assess the profitability of the franchisee's current business. Consistently low sales or financial losses could justify a relocation to a site with greater potential.
Finally, Endless Summer Sweets will consider circumstances beyond the franchisee's control that lead to a loss of the current premises. For example, if the building is damaged by a natural disaster or the lease is terminated unexpectedly, Endless Summer Sweets may approve a relocation request. It is important to note that even if one or more of these factors are present, Endless Summer Sweets is not obligated to approve the relocation. The decision remains at their discretion.
