If you sign a franchise agreement with us, you will develop and operate a themed restaurant created to revive the kid in you, bringing back memories of the neighborhood fairs with family and friends. We commit to using local ingredients, whenever possible, and offer fun, fair food, at its finest. If you sign a Multi-Unit Development Agreement you will develop multiple Endless Summer Sweets restaurant outlets, on an agreed-upon schedule. Our form of Multi-Unit Development Agreement is attached as Exhibit C to this disclosure document. For each franchise after the first, we will require you to sign our then-current form of franchise agreement, which may be different from the form of franchise agreement included in this disclosure document.
Your franchised restaurant(s) will use a system we developed. Distinguishing characteristics of our system include distinctive exterior and interior layout, design and color scheme; signage, decor, furnishings and materials; special recipes, menus and food and beverage designations; our confidential operations manual, preparation and service procedures and techniques; advertising, operating procedures and other aspects of the restaurant. We can change elements of the system.
Your restaurant will operate under the name Endless Summer Sweets plus design, logos, commercial symbols and other trade names, service marks and trademarks that are now or later may be part of our system.
Market Competition
The restaurant industry is well developed. Our products and services are offered yearround. You will compete for customers with specialty snack franchises and stores, fairs, independent owners, national chains, regional chains, and franchised fast causal restaurants serving various menu items and cuisine. We are not aware of any restaurants that feature a full menu of summer fair food.
Laws and Regulations
You will also be subject to state and local licensing laws, codes and regulations, as they relate to the operation of a restaurant business.

What This Means (2024 FDD)
According to the 2024 Endless Summer Sweets Franchise Disclosure Document, franchisees will operate a themed restaurant. The franchise agreement specifies that the restaurant should revive the feeling of neighborhood fairs. The restaurant will use a system developed by Endless Summer Sweets, which includes a distinctive exterior and interior layout, design and color scheme; signage, decor, furnishings and materials; special recipes, menus and food and beverage designations; a confidential operations manual, preparation and service procedures and techniques; advertising, operating procedures and other aspects of the restaurant. All sales must be made from this physical location.
Endless Summer Sweets requires franchisees to buy or lease and use a computer system to manage the business. As of the FDD's issuance date, the required system includes iPads and the Square point of sale system, monitors, fax, scanner, and QuickBooks. The purchase price for the Square POS system and other hardware and software is approximately $500 to $1,500 per location. The estimated annual cost of maintenance, updating, upgrading, or support contracts for the software is approximately $1,200.
Endless Summer Sweets maintains a website to advertise and promote the franchise. All franchisees must use the website. Franchisees are not permitted to operate a separate website for their Endless Summer Sweets restaurant business without prior approval from Endless Summer Sweets. Franchisees must also obtain prior written approval to use electronic media, including the Internet, or any social media, for viewing by the public that contains or is associated with their Endless Summer Sweets restaurant business or Endless Summer Sweets' registered trademarks. Endless Summer Sweets retains the right to approve all social media content that displays or is associated with their trademarks or the franchisee's business and may require franchisees to withdraw or discontinue the use of any social media posts or content, even if previously approved.
