Is Endless Summer Sweets required to maintain a website for the brand?

At our option, we may establish one or more websites to advertise, market and promote the System and the franchise opportunity. We currently maintain a website; however, we are not obligated to continue to maintain that website and may ,but are not required to, create additional or replacement websites. In any website, we may provide you with a listing for your location, or a web page to promote your business, if you provide us with the information that we request to develop your web page. All franchisees must use our website. We do not permit franchisees to operate a separate website for or in connection with their Endless Summer Sweets restaurant business without our prior approval.
We may provide you with materials for use on social media sites such as a Facebook page. You may not use any electronic media, including the Internet, or any social media, for viewing by the public that contains or is associated with your Endless Summer Sweets restaurant business or our registered trademarks without our prior written approval. You may not establish a Facebook®, MySpace®, SnapChat®, Twitter®, TikTok or similar pages, post through Instagram® or on YouTube®, or utilize other, similar social media in connection with the business, without our prior written approval. You may not establish a Twitter® feed or other social media that are associated with or refer to your Endless Summer Sweets restaurant business without our prior, written approval. We retain the right to approve all social media content that displays or is associated with our trademarks or your business. We may require you to withdraw or discontinue the use of any social media posts or content, even if previously approved.

According to Endless Summer Sweets' 2024 Franchise Disclosure Document, Endless Summer Sweets may establish one or more websites to advertise, market, and promote the system and the franchise opportunity. While Endless Summer Sweets currently maintains a website, they are not obligated to continue maintaining it and may create additional or replacement websites at their discretion.
For franchisees, Endless Summer Sweets may provide a listing for their location or a webpage to promote their business on any website they maintain, provided the franchisee supplies the requested information. All franchisees must use the Endless Summer Sweets website. However, franchisees are not allowed to operate a separate website for their Endless Summer Sweets restaurant business without prior approval from Endless Summer Sweets.
Endless Summer Sweets also outlines specific requirements regarding social media usage. Franchisees may receive materials for use on social media sites like Facebook. However, franchisees need written approval before using any electronic media, including the Internet or social media, that contains or is associated with their Endless Summer Sweets restaurant business or Endless Summer Sweets' registered trademarks. This includes establishing pages on platforms like Facebook, MySpace, SnapChat, Twitter, TikTok, Instagram, or YouTube, or using other similar social media in connection with the business without prior written approval. Endless Summer Sweets retains the right to approve all social media content that displays or is associated with their trademarks or the franchisee's business and may require the franchisee to withdraw or discontinue the use of any social media posts or content, even if previously approved.
