Does Endless Summer Sweets require all franchisees to use their website?

According to the 2024 Endless Summer Sweets FDD, all franchisees must use the Endless Summer Sweets website. The FDD specifies that Endless Summer Sweets may establish websites to promote the system and franchise opportunity. While Endless Summer Sweets currently maintains a website, they are not obligated to continue doing so and may create additional or replacement websites.

Endless Summer Sweets may provide franchisees with a listing for their location or a webpage to promote their business on the website, contingent on the franchisee providing the necessary information. However, franchisees are not allowed to operate a separate website for their Endless Summer Sweets restaurant without prior approval from Endless Summer Sweets.

Additionally, franchisees need written approval to use electronic media or social media that contains or is associated with their Endless Summer Sweets restaurant business or Endless Summer Sweets' registered trademarks. This includes platforms like Facebook, MySpace, SnapChat, Twitter, TikTok, Instagram, and YouTube. Endless Summer Sweets retains the right to approve all social media content that displays or is associated with their trademarks or the franchisee's business and may require franchisees to remove any social media posts or content, even if previously approved.
