- B. The System includes (1) methods, procedures, and standards for developing and operating an Endless Summer Sweets business, (2) plans, specifications, equipment, signage and trade dress for Endless Summer Sweets businesses, (3) particular products and services, (4) the Marks, (5) training programs, (6) business knowledge, (7) marketing plans and concepts, and (8) other mandatory or optional elements as determined by Franchisor from time to time.
- C. The parties desire that Franchisor license the Marks and the System to Franchisee for Franchisee to develop and operate an Endless Summer Sweets business on the terms and conditions of this Agreement.
ARTICLE 1. DEFINITIONS
- "Action" means any action, suit, proceeding, claim, demand, governmental investigation, governmental inquiry, judgment or appeal thereof, whether formal or informal.
- "Approved Vendor" means a supplier, vendor, or distributor of goods or services which has been approved by Franchisor.
- "Business" means Franchisor's business owned by Franchisee and operated under this Agreement.

What This Means (2024 FDD)
According to the 2024 Endless Summer Sweets FDD, the System that Endless Summer Sweets utilizes includes training programs. The FDD states that the System includes methods, procedures, and standards for operating an Endless Summer Sweets business, plans, specifications, equipment, signage and trade dress, particular products and services, the Marks, training programs, business knowledge, marketing plans and concepts, and other mandatory or optional elements as determined by Endless Summer Sweets.
Endless Summer Sweets offers standard pre-opening training to the franchisee's Principal Executive and up to one additional person at their headquarters or another designated location. Endless Summer Sweets does not charge a fee for this training, but the franchisee is responsible for their own travel, lodging, meal, and other out-of-pocket expenses. Endless Summer Sweets reserves the right to change the length and content of the initial training program based on the experience and skill level of the individuals attending the program.
Endless Summer Sweets will also have a representative support the franchisee's business opening with up to five days of onsite training and assistance around the time of opening. It is important for a prospective franchisee to discuss with Endless Summer Sweets the extent to which they are required to implement training programs for their own employees, and what resources and support Endless Summer Sweets provides for that purpose.
