What This Means (2024 FDD)

According to Endless Summer Sweets's 2024 Franchise Disclosure Document, franchisees are restricted from using electronic media or social media containing the Endless Summer Sweets trademarks without prior written approval. Specifically, franchisees cannot establish social media pages such as Facebook, MySpace, SnapChat, Twitter, or TikTok, post on Instagram or YouTube, or use similar social media platforms in connection with their Endless Summer Sweets restaurant business without first obtaining written consent from the franchisor.

Endless Summer Sweets retains the right to approve all social media content that displays or is associated with their trademarks or the franchisee's business. Even if previously approved, Endless Summer Sweets can require a franchisee to withdraw or discontinue the use of any social media posts or content. This control ensures that the brand's image is consistent and adheres to the franchisor's standards across all online platforms.

This policy has significant implications for prospective franchisees. It means that franchisees must be diligent in seeking approval for any online marketing or social media activities. Failure to obtain prior written approval or comply with a request to remove content could result in a breach of the franchise agreement. While this might seem restrictive, it is a common practice in franchising to protect the brand's integrity and reputation. Franchisees should factor in the time and potential delays associated with seeking approval when planning their marketing strategies.
