What pre-opening plans and specifications will Endless Summer Sweets provide to the franchisee?

egarding Franchisee's employees and conditions of employment are Franchisee's sole responsibility.
- 5.3 Assistance in Training Employees. Franchisor shall, to the extent it deems appropriate, provide programs for Franchisee to conduct training of new employees.
5.4 Pre-Opening Assistance.
- (a) Selecting Location. Franchisor shall provide its criteria for Endless Summer Sweets locations to Franchisee. Franchisor will review and advise Franchisee regarding potential locations submitted by Franchisee.
- (b) Pre-Opening Plans, Specifications, and Vendors. Within a reasonable period of time after the Effective Date, Franchisor shall provide Franchisee with (i) Franchisor's sample set of standard building plans and specifications and/or standard recommended floor plans; (ii) the applicable System Standards, (iii) other specifications as Franchisor deems appropriate (which may include specifications regarding inventory, supplies, materials, and other matters), and (iv) Franchisor's lists of Approved Vendors and/or Required Vendors.
- (c) Pre-Opening Training. Franchisor shall make available its standard pre-opening training to Franchisee's Principal Executive and up to one additional person, at Franchisor's headquarters and/or at another location designated by Franchisor. Franchisor shall not charge any fee for this training. Franchisee is responsible for its own travel, lodging, meal, and other out-ofpocket expenses. Franchisor reserves the right to vary the length and content of the initial training program based on the experience and skill level of any individual attending the program.
- (d) Market Introduction Plan. Franchisor shall advise Franchisee regarding the planning and execution of Franchisee's market introduction plan.

According to the 2024 Endless Summer Sweets FDD, the franchisor provides franchisees with several forms of pre-opening assistance. Endless Summer Sweets will provide its criteria for selecting locations and will review and advise franchisees on potential locations they submit. This guidance aims to ensure franchisees choose suitable sites that align with the brand's standards.
Endless Summer Sweets will also provide franchisees with a sample set of standard building plans and specifications, along with recommended floor plans. Franchisees will also receive the applicable System Standards and other specifications the franchisor deems appropriate, which may include details on inventory, supplies, and materials. Additionally, franchisees will get lists of Approved Vendors or Required Vendors to help them source necessary items.
