What This Means (2024 FDD)

According to the 2024 Endless Summer Sweets Franchise Disclosure Document, prospective franchisees are advised to carefully read the disclosure document and all agreements. Endless Summer Sweets must provide the disclosure document to the franchisee at least 14 calendar days before they sign a binding agreement or make a payment to Endless Summer Sweets or an affiliate related to the proposed franchise sale. This allows the franchisee adequate time to review the document and seek professional advice.

This 14-day review period is a standard practice in franchising, mandated by the FTC and various state laws, to ensure franchisees have sufficient time to evaluate the opportunity. The disclosure document contains crucial information about the franchise system, including fees, obligations, and financial performance. Thoroughly reviewing these materials is essential for making an informed decision.

Furthermore, the disclosure emphasizes that if Endless Summer Sweets does not deliver the disclosure document on time, or if it contains false, misleading, or materially omissive statements, a violation of federal and state law may have occurred. In such cases, the franchisee should report this to the Federal Trade Commission and any applicable state agency listed in Exhibit A of the FDD. This provision protects potential franchisees by providing recourse if the franchisor fails to comply with disclosure requirements.
