If Franchisee leases the Location, Franchisee shall comply with its lease for the Location and make all rent payments when due.

Endless Summer Sweets also has specific rights related to the franchisee's lease. The landlord must provide Endless Summer Sweets with copies of any default notices issued to the franchisee and allow Endless Summer Sweets the option to cure the default within ten days after the franchisee's cure period expires. If the lease is terminated due to the franchisee's default, Endless Summer Sweets has the option to enter into a new lease with the landlord under the same terms as the original lease, provided they notify the landlord within fifteen days of receiving the termination notice. Furthermore, if the Franchise Agreement is terminated, the franchisee must assign the lease to Endless Summer Sweets upon their written request, and the landlord consents to this assignment.
Additionally, the franchisee is authorized to allow the landlord and Endless Summer Sweets to communicate directly regarding the franchisee and their business. Upon termination or expiration of either the Franchise Agreement or the lease, Endless Summer Sweets or its designee can enter the premises to remove any signs or materials bearing Endless Summer Sweets's branding, trademarks, and commercial symbols, provided they give reasonable notice and cover any damages caused by the removal. However, Endless Summer Sweets does not assume any liability regarding the leased premises or any obligations as a tenant under the lease by executing this rider.
