Is Endless Summer Sweets obligated to continue to maintain their current website?

At our option, we may establish one or more websites to advertise, market and promote the System and the franchise opportunity. We currently maintain a website; however, we are not obligated to continue to maintain that website and may ,but are not required to, create additional or replacement websites. In any website, we may provide you with a listing for your location, or a web page to promote your business, if you provide us with the information that we request to develop your web page. All franchisees must use our website. We do not permit franchisees to operate a separate website for or in connection with their Endless Summer Sweets restaurant business without our prior approval.
We may provide you with materials for use on social media sites such as a Facebook page. You may not use any electronic media, including the Internet, or any social media, for viewing by the public that contains or is associated with your Endless Summer Sweets restaurant business or our registered trademarks without our prior written approval. You may not establish a Facebook®, MySpace®, SnapChat®, Twitter®, TikTok or similar pages, post through Instagram® or on YouTube®, or utilize other, similar social media in connection with the business, without our prior written approval. You may not establish a Twitter® feed or other social media that are associated with or refer to your Endless Summer Sweets restaurant business without our prior, written approval. We retain the right to approve all social media content that displays or is associated with our trademarks or your business. We may require you to withdraw or discontinue the use of any social media posts or content, even if previously approved.

What This Means (2024 FDD)
According to the 2024 Endless Summer Sweets FDD, while Endless Summer Sweets currently maintains a website, they are not obligated to continue doing so. They have the option to create additional or replacement websites. Franchisees are required to use the Endless Summer Sweets website and cannot operate a separate website for their restaurant without prior approval from Endless Summer Sweets.
Endless Summer Sweets may provide franchisees with materials for social media sites like Facebook, but franchisees need written approval before using any electronic media or social media that contains or is associated with their Endless Summer Sweets restaurant business or the franchisor's trademarks. Franchisees must also obtain prior written approval to establish any social media pages or feeds associated with the business. Endless Summer Sweets retains the right to approve all social media content that displays or is associated with their trademarks or the franchisee's business and can require franchisees to remove any social media posts or content, even if previously approved.
This policy gives Endless Summer Sweets significant control over the brand's online presence and marketing. It also means that franchisees are dependent on Endless Summer Sweets for the maintenance of the brand website and for approval of their own online marketing efforts. A prospective franchisee should consider the implications of this dependency and ask Endless Summer Sweets about their plans for website and social media support.
