What This Means (2024 FDD)
According to Endless Summer Sweets's 2024 Franchise Disclosure Document, the Multi-Unit Development Agreement (MUDA) does not have a defined term length. The franchise agreement has a term of 10 years from the date of the franchise agreement.
Unlike the franchise agreement, the MUDA does not specify a term length. However, if a franchisee signs a MUDA, they can terminate it at any time. Termination of the MUDA by the franchisee does not give Endless Summer Sweets the right to terminate the franchise agreement. Conversely, if the franchise agreement is terminated, Endless Summer Sweets has the right to terminate the MUDA.
If a franchisee continues to operate their franchise after the expiration of the term without a renewal agreement, Endless Summer Sweets may either terminate the operation at any time or deem the agreement to have been renewed for an additional term. To renew the franchise agreement, a franchisee must provide advance notice, comply with all contractual obligations, renovate to current standards, sign the current franchise agreement and related documents, and sign a general release.
