What This Means (2024 FDD)
According to the 2024 Endless Summer Sweets Franchise Disclosure Document, Michigan law includes specific protections for franchisees. If a provision in the franchise documents allows Endless Summer Sweets to refuse renewal of a franchise on terms generally available to other franchisees of the same class or type under similar circumstances, that provision is void and unenforceable in Michigan. This protection ensures that Endless Summer Sweets franchisees in Michigan are not unfairly denied renewal opportunities that are offered to other franchisees. However, the FDD also states that this section of Michigan law does not require a renewal provision at all. Therefore, Endless Summer Sweets is not required to offer renewals, but if they do, they must be on equal terms.
This statute aims to prevent franchisors from discriminating against franchisees during the renewal process. It ensures that similarly situated franchisees are treated equitably when their franchise agreements are up for renewal. This provision is particularly important for franchisees who have invested time and resources into building their Endless Summer Sweets business and rely on the renewal option to continue operating.
However, it is important to note that this protection only applies if Endless Summer Sweets offers renewal options to its franchisees. The law does not mandate that Endless Summer Sweets must offer renewals, but if they choose to do so, the terms must be generally available to all franchisees of the same class or type under similar circumstances. A prospective franchisee should clarify with Endless Summer Sweets the specific conditions and criteria for franchise renewal to fully understand their rights and obligations under Michigan law.
