What This Means (2024 FDD)

According to the 2024 Endless Summer Sweets FDD, franchisees may be required to sign a general release under certain circumstances, such as a franchise renewal or the approval of a franchise sale. This release, if signed, would prevent the franchisee from initiating any claims against Endless Summer Sweets related to the Franchise Agreement. Specifically, the release covers all known and unknown claims arising from events up to the date of the release.

This agreement includes a covenant where the franchisee agrees not to participate in any legal proceedings against Endless Summer Sweets. This encompasses any civil, criminal, or administrative actions in any court or agency. The franchisee also agrees not to assist or encourage others in bringing such actions, reinforcing the intention to prevent litigation.

It is important for prospective Endless Summer Sweets franchisees to understand the implications of such a release. While it may be a standard requirement in certain situations, it effectively limits the franchisee's legal recourse against the franchisor. Franchisees should seek legal counsel to fully understand their rights and obligations before signing any such release.
