What This Means (2024 FDD)
According to the 2024 Endless Summer Sweets Franchise Disclosure Document, the lease agreement allows for subletting under specific conditions. The tenant, as a franchisee, has the right to assign or sublet the lease to Endless Summer Sweets Franchising, Inc. This is permitted regardless of any provisions in the lease that might otherwise restrict such actions. However, it's important to note that even with such an assignment or sublease, the original tenant (franchisee) remains liable under the lease agreement, unless otherwise negotiated.
Furthermore, if Endless Summer Sweets becomes the lessee, the company then has the right to assign or sublease the lease to another Endless Summer Sweets franchisee. This provision ensures that Endless Summer Sweets has the flexibility to manage the location and continue operations under the brand, even if the original franchisee is no longer operating the business. This clause also stipulates that any limitations in the lease that restrict the tenant's ability to own or operate other Endless Summer Sweets outlets in proximity to the leased premises do not apply to Endless Summer Sweets itself.
This arrangement benefits both the franchisee and Endless Summer Sweets. It provides an exit strategy for the franchisee while ensuring the continued operation of the franchise at that location under the brand. However, franchisees should be aware that they remain liable under the lease even if they sublet or assign it to Endless Summer Sweets, which means they should carefully consider the terms of the lease and their financial obligations.
Prospective franchisees should consult with legal counsel to fully understand the implications of these lease provisions and how they might affect their specific circumstances. Understanding these terms is crucial for making an informed decision about investing in an Endless Summer Sweets franchise.
