If we and you cannot agree on a site, you will be unable to comply with your obligation to develop and open the franchise by the deadline stated in the franchise agreement.

What This Means (2024 FDD)
According to Endless Summer Sweets's 2024 Franchise Disclosure Document, a franchisee may face default and potential termination of their franchise agreement if they fail to meet the opening deadline specified in the agreement, unless an extension is granted by Endless Summer Sweets. This situation arises if the franchisee and Endless Summer Sweets cannot agree on a suitable site for the business.
Site selection is a critical step, and Endless Summer Sweets offers some assistance by reviewing and advising on potential locations submitted by the franchisee. However, the ultimate responsibility for finding a suitable site lies with the franchisee. The franchisor specifies the area in which the site must be selected and requires the franchisee to provide all necessary information and documents for approval. Factors considered for site approval include general location, competition, demographics, traffic patterns, parking, size, physical characteristics, and lease terms.
If the franchisee fails to secure an approved site within the timeframe stipulated in the franchise agreement, they risk being in default. Unless Endless Summer Sweets agrees to extend the deadline, the franchisor reserves the right to terminate the franchise agreement. This underscores the importance of diligent site selection and proactive communication with Endless Summer Sweets to avoid potential default and termination.
