What This Means (2024 FDD)

According to the 2024 Endless Summer Sweets FDD, the franchisor exerts considerable control over the franchisee's business operations. Endless Summer Sweets requires franchisees to adhere to specific standards and procedures outlined in the franchise agreement.

Specifically, franchisees need prior written approval from Endless Summer Sweets for public statements related to the business, involvement with causes or organizations, and engaging a third-party management company. Franchisees must also identify themselves as independent owners in a manner prescribed by Endless Summer Sweets and follow the franchisor's code of ethics. These stipulations ensure brand consistency and protect the goodwill associated with Endless Summer Sweets's marks.

Moreover, franchisees are restricted from operating any other business at the approved location besides the Endless Summer Sweets business. The franchisor also retains significant control upon termination or expiration of the franchise agreement, including the right to de-identify the location and take control of phone numbers, websites, and listings associated with the brand. These measures ensure that franchisees adhere to the franchisor's standards and protect the brand's integrity both during and after the franchise term.
