What This Means (2024 FDD)

According to the 2024 Endless Summer Sweets FDD, under certain circumstances, a franchisee may be required to sign a general release, which could limit their ability to make claims against the franchisor. Specifically, Endless Summer Sweets may require a franchisee to sign a general release as a condition of franchise renewal or as a condition for the franchisor's approval of a sale of the franchise.

The FDD includes a form of general release as Attachment 4 to the Franchise Agreement. This release, if executed, would be made in favor of Endless Summer Sweets Franchising, Inc. The release stipulates that the Releasor (franchisee) releases Endless Summer Sweets, its affiliates, and their respective directors, officers, shareholders, and employees.

This type of release is a legal document where the franchisee agrees to waive any existing or future claims against the franchisor. Prospective franchisees should carefully review the circumstances under which they might be asked to sign such a release and understand the implications of waiving their rights. It is advisable to seek legal counsel before signing any document that limits their ability to pursue claims against Endless Summer Sweets.
