According to the 2024 Endless Summer Sweets Franchise Disclosure Document, the franchise offering includes a Franchise Agreement. The document states that if you sign a franchise agreement with Endless Summer Sweets, you will develop and operate a themed restaurant.
Endless Summer Sweets grants the franchisee the right to operate one Endless Summer Sweets business solely at the specified location for the entire term of the agreement. The franchisor also provides an exclusive territory where they will not establish another business selling similar goods or services under the same trademarks.
The Franchise Agreement also contains various clauses, including those related to termination upon bankruptcy, covenants not to compete extending beyond the franchise term, and liquidated damages. The agreement also mandates mediation in Berkely, California, with costs shared equally between Endless Summer Sweets and the franchisee.
