What This Means (2024 FDD)
According to the 2024 Endless Summer Sweets Franchise Disclosure Document, the standard franchise agreement grants the franchisee the right to operate only one Endless Summer Sweets business at a specific location. Section 2.1 of the agreement states that the franchisor grants the franchisee the right to operate one Endless Summer Sweets business solely at the specified location. The franchisee is obligated to develop, open, and operate the business at that location for the entire term of the agreement. This indicates that the standard agreement is for a single unit.
However, Endless Summer Sweets also offers a Multi-Unit Development Agreement (MUDA). This agreement allows a franchisee to commit to developing and opening multiple Endless Summer Sweets businesses according to a pre-defined schedule. The MUDA does not, on its own, grant the right to operate these businesses; instead, it requires the franchisee to execute a separate franchise agreement for each additional location. This means that while the MUDA outlines the commitment to multiple units, each unit is governed by its own franchise agreement.
In summary, while the standard Endless Summer Sweets franchise agreement is for a single unit, the Multi-Unit Development Agreement provides a mechanism for franchisees to expand and operate multiple locations, each under its own franchise agreement. Prospective franchisees interested in operating multiple units should carefully review the terms and conditions of the MUDA in conjunction with the standard franchise agreement to understand their obligations and the franchisor's expectations for multi-unit development.
