- 2. Form of Agreement. For the first location, Franchisee and Franchisor have executed the Franchise Agreement simultaneously with this MUDA. For each additional franchise, Franchisee shall execute Franchisor's then-current standard form of franchise agreement no later than three business days after Franchisee leases or acquires a location for the franchise. This MUDA does not give Franchisee the right to construct, open, or operate an Endless Summer Sweets business, and Franchisee acknowledges that Franchisee may construct, open, and operate each Endless Summer Sweets business only pursuant to a separate franchise agreement executed pursuant to this MUDA for each Endless Summer Sweets business.

What This Means (2024 FDD)
According to the 2024 Endless Summer Sweets Franchise Disclosure Document, if you sign a Multi-Unit Development Agreement (MUDA) to develop multiple Endless Summer Sweets restaurant outlets, you will be required to sign the then-current standard form of the franchise agreement for each franchise after the first location. This agreement must be executed no later than three business days after you lease or acquire a location for the franchise.
This means that while the initial franchise agreement is signed simultaneously with the MUDA for the first location, each subsequent location will require a separate, potentially updated, franchise agreement. The terms and conditions in these later agreements could differ from the original, so it's important to review them carefully.
It is important to note that the MUDA itself does not grant the right to open and operate an Endless Summer Sweets business. Each location requires its own franchise agreement. This ensures that Endless Summer Sweets can maintain control over its brand standards and operational procedures as the franchise system evolves.
