What This Means (2024 FDD)
According to the 2024 Endless Summer Sweets FDD, 'Gross Sales' is defined as the total revenue from all sales generated by the franchise, whether paid in cash or credit. However, the FDD specifies certain items that are excluded from this calculation.
Specifically, the following are not included in the calculation of Gross Sales for an Endless Summer Sweets franchise: (i) bona fide refunds to customers, (ii) sales taxes collected by the franchisee, (iii) sales of used equipment not in the ordinary course of business, and (iv) sales of prepaid cards or similar products. However, it is important to note that while the initial sale of prepaid cards is excluded, the redemption of these cards for goods or services is included in Gross Sales.
This definition is important for franchisees because royalty fees and other payments to Endless Summer Sweets are typically based on a percentage of Gross Sales. Understanding what is included and excluded ensures accurate reporting and payment of these fees. Franchisees should pay close attention to these exclusions to avoid overreporting sales and overpaying royalties.
