What This Means (2024 FDD)

The 2024 Endless Summer Sweets Franchise Disclosure Document discusses the franchisor's right to enter the premises under specific circumstances related to the lease agreement. Endless Summer Sweets, or its designee, can enter the leased premises to remove signs and other materials bearing the Endless Summer Sweets brand name, trademarks, and commercial symbols. This right is only granted upon the expiration or termination of the Franchise Agreement or the Lease, or the termination of the franchisee's right of possession of the leased premises.

However, this entry is not unconditional. Endless Summer Sweets must provide reasonable prior notice to the landlord before entering the premises for removal purposes. Additionally, Endless Summer Sweets is liable to the landlord for any damage that they or their designee cause during the removal process.

This clause primarily protects Endless Summer Sweets' brand identity and ensures that its trademarks and commercial symbols are removed from a location that is no longer operating as an Endless Summer Sweets franchise. It does not grant Endless Summer Sweets a general right to enter the premises for inspection or other purposes during the normal operation of the franchise. A prospective franchisee should clarify with Endless Summer Sweets the specific conditions under which the franchisor can access the premises during the franchise term for inspections or other operational oversight.
