What This Means (2024 FDD)
According to the 2024 Endless Summer Sweets Franchise Disclosure Document, if the Franchise Agreement between the franchisor and the tenant is terminated during the term of the lease, the tenant is required to assign the lease to Endless Summer Sweets, provided that Endless Summer Sweets makes a written request for the assignment. The landlord consents to this assignment.
This clause protects Endless Summer Sweets by allowing them to maintain control of the location if a franchisee's agreement is terminated. This ensures business continuity and protects the brand's presence in that market. For a prospective franchisee, this means that upon termination of their franchise agreement, they may be required to relinquish their lease to Endless Summer Sweets, potentially losing their business location.
This is a fairly standard clause in franchise agreements, as franchisors typically want to maintain control over key assets like the lease to ensure consistent brand representation and operational standards. Franchisees should carefully consider this provision and understand the circumstances under which their lease could be assigned to the franchisor.
