What This Means (2024 FDD)
According to Endless Summer Sweets' 2024 Franchise Disclosure Document, the approval of future site locations and territories is dependent on signing a Multi-Unit Development Agreement. If a franchisee enters into such an agreement with Endless Summer Sweets, the franchisor will then approve the locations of future sites and territories. The FDD specifies that the franchisor's standards for sites and territories at that time will be the ones applied.
Endless Summer Sweets is not obligated to assist franchisees in locating a site or negotiating the purchase or lease of the site. If the site is not already known and approved when the franchise agreement is signed, the franchisor will specify the area in which the franchisee must select a site. The selected site is subject to the franchisor's approval, and the franchisee must provide all required information and documents about the site to obtain this approval.
The factors that Endless Summer Sweets considers when approving sites include the general location and neighborhood, competition, trade area demographics, traffic patterns, parking, size, physical characteristics of existing buildings, and lease terms. The franchisor has 30 days to approve or disapprove a proposed site after the franchisee submits all required documents and information. If the franchisee and Endless Summer Sweets cannot agree on a site, the franchisee may be unable to meet the deadline for opening the franchise, potentially leading to a default and termination of the franchise agreement unless an extension is agreed upon.
