What This Means (2024 FDD)
According to Endless Summer Sweets's 2024 Franchise Disclosure Document, if the Franchise Agreement is terminated or expires, the franchisee is responsible for de-identifying the location. Within 30 days of the termination or expiration of the agreement, the franchisee must remove all Endless Summer Sweets trademarks, signage, and trade dress from the location.
The de-identification must be done at the franchisee's own expense. The goal is to ensure that the location no longer appears to be an Endless Summer Sweets business.
Critically, the de-identification must be completed to the reasonable satisfaction of Endless Summer Sweets. This gives Endless Summer Sweets some control over how thoroughly the location is de-identified, ensuring it meets their standards and protects their brand image. A prospective franchisee should clarify what "reasonable satisfaction" entails to avoid potential disputes over the adequacy of the de-identification efforts.
