What This Means (2024 FDD)

According to the 2024 Endless Summer Sweets FDD, Michigan law has specific stipulations regarding franchise terminations. If a franchise agreement contains provisions allowing Endless Summer Sweets to terminate the franchise before its term expires without 'good cause', those provisions are void and unenforceable in Michigan.

In Michigan, 'good cause' for termination includes the franchisee's failure to comply with any lawful provision of the franchise agreement. However, Endless Summer Sweets must provide the franchisee with written notice of the failure and a reasonable opportunity to correct it. Michigan law specifies that this cure period does not need to exceed 30 days.

This protection ensures that Endless Summer Sweets franchisees in Michigan are not subject to arbitrary or unfair termination. It aligns with the state's effort to balance the franchisor's need to maintain brand standards with the franchisee's investment and reliance on the franchise agreement. Prospective franchisees should be aware of these Michigan-specific protections, as they may differ from the standard terms in the franchise agreement and the laws of other states.
